Terms
These Terms govern the use of Planua, including free accounts, paid subscriptions, AI-generated output, and team features. The German version is authoritative.
1. Scope
These Terms apply to the use of the Planua website and SaaS product by business and private customers. Individual written agreements take precedence where expressly agreed.
2. Service Description
Planua provides a web-based service for AI-assisted virtual staging, room-image editing, project management, subscription management, and related collaboration functions. We may refine, improve, or adapt the service where this is reasonable for users.
3. Accounts And Acceptable Use
- Users must provide accurate account information and keep credentials confidential.
- Users may only upload content they are authorized to use and process.
- Unlawful, infringing, deceptive, abusive, or security-threatening use is prohibited.
- Users must not use the service to process content that violates third-party rights or applicable law.
4. AI Output And Availability
AI-generated output is probabilistic and may be incomplete, inaccurate, or unsuitable for a specific commercial purpose. Planua does not guarantee uninterrupted availability, defect-free AI output, or a specific business result unless mandatory law requires otherwise.
5. Subscription Plans, Billing, And Renewal
Planua offers a free tier and monthly paid subscriptions. Paid plans renew automatically for successive monthly billing periods unless canceled in time for the end of the current period.
Billing is processed through Stripe. The plan details shown at checkout form part of the contract. Price adjustments for future periods remain reserved with prior notice and in accordance with applicable law.
6. Cancellation
Paid subscriptions can be canceled at any time with effect for the end of the current billing period. After cancellation, access to paid features remains available until the end of the already paid period.
7. Consumer Withdrawal Information
If you are a consumer, statutory withdrawal rights may apply. Where the paid service is to start immediately after checkout, we ask for an express request to begin performance before the withdrawal period ends and for an acknowledgment of the legal consequences.
Depending on the legally applicable classification of the booked service and the state of performance at the time of withdrawal, the withdrawal right may expire once performance has been fully provided or a proportionate amount may be owed for services already rendered during the withdrawal period.
8. Refunds
Outside mandatory statutory rights, refunds are granted only on a case-by-case basis. This does not affect mandatory consumer rights, including any applicable withdrawal rights.
9. Team Features
Team owners are responsible for invites, seat usage, and billing decisions within shared workspaces. Users invited into a team workspace may lose access if their team membership ends.
10. Rights In Content
Users retain their rights in uploaded content. To the extent necessary to provide the service, users grant us the rights required to store, process, transform, and display uploaded content and generated output within the service and through engaged processors.
11. Liability
We are liable without limitation for intent, gross negligence, injury to life, body, or health, and under mandatory statutory liability regimes. In cases of ordinary negligence, we are liable only for breach of essential contractual obligations and limited to the foreseeable, typical damage. Mandatory statutory rights remain unaffected.
12. Governing Law
German law applies. If you are a consumer, mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected.
13. Consumer Dispute Resolution
We are neither willing nor obliged to participate in proceedings before a consumer arbitration board.
